Our fitness center is located on the 1st floor on the west side of 1011 East Touhy. In order to access this new facility, registration and a one-time membership payment of $12 are required. To register, please complete the online form and use the Paypal options below to submit a one-time fee for your access card.

In consideration of the opportunity provided to me to utilize the fitness room, I

understand and agree as follows:

Fitness Room User Agreement Release & Waiver of Liability

1. To the best of my knowledge, I am physically sound and have medical approval by my doctor to participate in physical exercise activities of the type normally engaged in a voluntary health & fitness facility.

2. I understand and agree that the use of the Fitness Room is voluntary. I understand and agree that I am responsible for learning how to use the equipment properly and safely. If I do not know how to properly use any piece of equipment in the Fitness Room, I WILL NOT USE IT. I agree to refrain from using equipment that I determine to be defective or in need of maintenance or repair. I am responsible for establishing and maintaining my own exercise program. Should instruction be offered, I hold myself responsible for any potential injuries that may occur. I understand that a risk of injury is present when engaging in or utilizing the Fitness Room and I assume all responsibilities and risk of my participation in the use of the Fitness Room.

3. I understand and agree that the Fitness Room, its shower and locker areas are not staffed and that at any given time there may be water, shampoo, conditioner, lotion or other “slip agent” and/or “slip and fall agent” on the floor of the Fitness Room, its shower and locker areas. I accept that it is my responsibility to exercise extreme caution with respect to the possibility of my injuring myself in a slip and fall accident.

4. The QUIET ENJOYMENT of the Fitness Room is exclusively for the tenants and the tenants’ employees of 999 E. Touhy, 1011 E. Touhy and 1111 E. Touhy. Family members, friends and others are not allowed to use the facilities and equipment without express written permission by Siete 7 LLC. Users of the Fitness Room understand and agree that the activities in the Fitness Room itself, not the locker or shower area, are being recorded on video and that the videos will be reviewed from time to time.

5. I understand that Siete 7 LLC and ADM 2 LLC reserve the right to change or cancel the continued availability of the Fitness Room without liability to me. No lease, license or bailment is created by my use of the Fitness Room. Neither Siete 7 LLC nor ADM 2 LLC is liable for any loss or damage to my property.

6. IN CONSIDERATION OF THE ACCEPTANCE OF MY EXERCISE AGREEMENT, I THE UNDERSIGNED
INTENDED TO BE LEGALLY BOUND FOR MYSELF, MY HEIRS, EXECUTORS, AND ADMINISTRATORS DO HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS SIETE7 LLC AND ADM2 LLC AND THEIR REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL LIABILITY ARISING FROM INJURIES, INCLUDING DEATH, THAT I MAY SUFFER AS A RESULT OF MY USE OF THE FITNESS ROOM, ITS SHOWER AND LOCKER AREAS.

7. MY SIGNATURE ON THIS WAIVER IS EVIDENCE I WAS INFORMED BY SIETE 7 LLC AND ADM 2 LLC THAT BEFORE PARTICIPATING IN ANY FITNESS ACTIVITY IN THE FITNESS ROOM LOCATED AT 1011 E. TOUHY AVE., DES PLAINES, IL 60018, I SHOULD CHECK WITH MY DOCTOR TO SEE IF THE EXERCISE EQUIPMENT AND INSTRUCTIONS ARE SUITABLE FOR MY HEALTH AND PHYSICAL CONDITION.

8. I HAVE CAREFULLY READ THIS AGREEMENT, RELEASE & WAIVER LIABILITY, AND I KNOW ITS CONTENTS. I HAVE VOLUNTARILY SIGNED AS MY OWN FREE ACT.
